Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was detained in immigration custody.

In her order, the judge noted that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The legal challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his petition to deportation in a federal court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
