Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and novelty within the sport motivated his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared operational insights of his racing venture, revealing he put in $40m of his own funds into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”
The Core Dispute: Charter Agreements and Renewal Demands
At issue is the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, like the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for an hour and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the sports legend.
Leading the Legal Charge
23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a business model Jordan said is unlawful to maintain excessive control.
For Jordan and and Heather Gibbs, who preceded Jordan, are events from last September. Gibbs described a frantic and emotional period where the racing circuit informed teams they must sign a contract extension. This agreement consists of 112 pages outlining pay for chartered teams and a guaranteed entry in every race.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to decline to sign that extensive document and take the issue to court. The other 13 organizations agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar refused to engage, Jordan said.
The Ultimate Motivation: Victory
But in the end, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.
“Hamlin persuaded me getting a third driver boosted our odds of winning,” he testified, noting that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.
She said, the team founder first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader refused the appeal.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
